NOTICE OF INTENT TO CONSIDER ISSUANCE OF A CABLE FRANCHISE
and
NOTICE OF PUBLIC HEARING
TO CONSIDER ISSUANCE OF A CABLE FRANCHISE
Notice is hereby given that it is the intent of the City Council of the City of Prior Lake, Scott County, Minnesota, to consider issuance of a franchise authorizing operation of a system to provide cable service in the City. This notice is given in accordance with Minnesota Statutes, Chapter 238. Notice is also given of a Public Hearing regarding the issuance of a cable franchise before the City Council at City Hall, 4646 Dakota Street SE beginning at 7:00 p.m. on July 22, 2025.
Any person seeking to provide cable service must submit an application. The application requirements are set forth in Minnesota Statutes Section 238.081 subd. 4. Copies of the official application instructions are available upon request at City Hall.
- Applications in response to this Notice must be submitted to the City by 4:30 p.m., June 27, 2025.
- Applications must be in writing, notarized, and consistent with the application instructions. Applicants must submit an original and two copies of the application.
- Each application shall be submitted along with an application fee of $10,000 in the form of a certified check made payable to the City of Prior Lake, Minnesota.
- Applicants are requested to be present at a public hearing before the City Council beginning at 7:00 p.m. on July 22, 2025.
- The minimum system design and services to be offered must meet or exceed those required of the incumbent cable operator pursuant to the City’s existing cable franchise. The desired design includes a system: serving the entire City based on a reasonable service area/line extension policy; capable of delivering in excess of 100 video programmed channels with the potential for increasing channels; providing a reasonable number of public, educational and governmental access channels and reasonable access support, and; providing connections and free services to the City Hall and other City facilities. Desired operations and services include: reasonable rates; a mix, level and quality of programs and services comparable to other systems, and; customer service and system maintenance plans to ensure the provision of high-quality services to the subscriber.
- Upon review of the application(s) and completion of the public hearing, the City will make a recommendation regarding award of franchises. Such recommendation shall be based on applicable law and the record including the application, information provided by the applicant, and other relevant information received by the City including the results of any negotiations with applicant(s) and any information submitted by the incumbent franchise company.
- In no event will submission of a conforming application entitle any applicant to receive a franchise and the City expressly reserves the right to reject both conforming and non-conforming applications.
- Any applicant(s) selected by the City Council will be required to accept the Franchise granted within thirty (30) days after adoption. Applicants will be required to reimburse the City for any expenses not covered by the application fee.
